The IDEA defines related services as follows:

(A)? IN GENERAL- The term ?related services? means transportation, and such developmental, corrective, and other supportive services (including speech-language pathology and audiology services, interpreting services, psychological services, physical and occupational therapy, recreation, including therapeutic recreation, social work services, school nurse services designed to enable a child with a disability to receive a free and appropriate public education as described in the individualized education program of the child, counseling services, including rehabilitation counseling, orientation and mobility services, and medical services, except that such medical services shall be for diagnostic and evaluation purposes only) as may be required to assist a child with a disability to benefit from special education?

(B)? EXCEPTION?The term does not include a medical device that is surgically implanted, or the replacement of such device.

????????????? The issue of related services has resulted in two decisions by the United States Supreme Court.?? The first decision was? Irving Independent Sch. Dist. v. Tatro ?468 U.S. 883, 104 S.Ct. 3371, 555 IDELR 511 (1984).? The Court affirmed the Court of Appeals holding that a procedure known as clean intermittent catheterization was a related service because the student could not attend school without it and, therefore, without the procedure she could not benefit from special education.? Tatro, supra.? The Supreme Court also affirmed the holding of the Court of Appeals that clean intermittent catheterization is not exempted by the medical services provision because the procedure did not have to be performed by a doctor, it could be done by a layperson with an hour of training. Tatro, supra.

????????????? The second decision was Cedar Rapids Community Sch. Dist. v. Garret F.? 526 U.S. 66, 119 S.Ct. 992, 29 IDELR 966 (1999).? In this case, the Supreme Court held that urinary bladder catheterization and suctioning of tracheotomy plus various monitoring was a related service.? Garret F., supra.? Applying the ?bright line? test of the Tatro decision, the Court held that because the related services did not have to be performed by a physician, the medical services exclusion did not apply and the schools were required to provide the services for the student.? Garret F., supra.? The Court specifically and emphatically rejected the argument raised by the schools that the cost of providing the services was a defense.? Garret F., supra.?

????????????? In Marshall Joint Sch Dist No.2 v CD by Brian & Traci D 616 F. 3d 632, 54 IDELR 307 (7th Cir 8/2/10), the Seventh Circuit? concluded that the student did not need specialized instruction.? Any need for PT or OT, therefore, was not relevant.

Small fire breaks out near Khartoum arms factory

KHARTOUM (Reuters) - A small fire broke out on Friday near Sudan's biggest arms factory in the capital Khartoum, a witness and state media said, two days after Sudan accused Israel of bombing the site.

Sudan, which analysts say is used as an arms-smuggling route to the Hamas-controlled Gaza Strip via neighboring Egypt, said on Wednesday an Israeli air strike had caused a huge explosion and fire at the plant. Israel has declined to comment.

Black smoke rose from the area of the heavily-guarded Yarmouk factory compound, a Reuters reporter said, but the fire appeared to be small without any explosions in contrast to the large flames and blasts on Tuesday night.

It was impossible to get closer to the gated site.

Firefighters brought the fire under control in a tree-lined grassed area of an industrial zone near the plant, state news agency SUNA said.

"There is no relation to sabotage or an explosion," police spokesman as-Sir Ahmed Omar told SUNA, adding that there were no casualties.

The governor of Khartoum state Abderlrahman al-Khidir said the death toll from Tuesday's strike had risen to four from the previously reported two, state news agency SUNA said. The attack had damaged 35 apartments and other places.

He said President Omar Hassan al-Bashir had ordered him to remove parts of the plant, Sudan's biggest factory for ammunition and small arms, to an area outside the residential area.

Khidir had initially ruled out an "external" reason for the fire on Tuesday night.

In May, Sudan said one person had been killed after a car exploded in the eastern city of Port Sudan. It said the explosion resembled a blast last year that it had blamed on an Israeli missile strike.

Israel declined to comment on the May incident or the 2011 blast, which killed two people and neither admitted nor denied involvement in a similar incident in eastern Sudan in 2009.

TSA Lets Sickly Taiwan-Bound Cat Loose In JFK Airport ? The ...

Xiaohwa is a pretty ordinary 4-year-old tabby who lives in Queens. Her owner had to temporarily move back to Taiwan to care for her ailing father, and misses her cat, so a friend traveling there agreed to bring Xiaohwa along. Their flight took off a week ago, but there was no cat on it. During a TSA check, she escaped from her carrier. Now she?s been on her own at New York?s John F. Kennedy Airport for seven days.

Xiaohwa is physically frail. She has a weakened immune system due to feline immunodeficiency virus, and her owner was advised to put her to sleep after a difficult kitten birth a few years ago.

In a statement, the TSA told the New York Times:

T.S.A. officers screened the pet and its carrier properly. It is unfortunate that the pet is missing at the airport. But, as a reminder, passengers are responsible for their pets throughout the screening process.

A year ago, Jack the cat fell through the ceiling 61 days after American Airlines baggage handlers let his crate fall open at JFK airport. The extended period without food took too much of a toll, and he was euthanized. The Facebook group organized to get word out about his cause is still active, now posting bulletins about other pets missing in airports in the hope that they won?t suffer the same fate.

Using Winemaking Waste For Making Fuel

Yearly, a single suburban home will produce several hundred pounds of lawn clippings, the primary components of which are cellulose and water. Other sources are ornamental tree trimmings, and waste paper pulp products.

I think you flunked earth sciences. The lawn needs those things; It composts and reduces to fertilizer for the next year. Same with leaves and such. The reason our crop yields are falling and most of our cities are basically slabs of clay with a few inches of top soil over the top is because we're constantly trimming, mowing, and raking away all the nutrients that the plants need to survive and replacing it with pesticides, synthetic fertilizer, and all manner of chemicals that are dangerous to us.

I'm not discounting the source: I'm simply pointing out it's already marked for a different use, courtesy mother nature. Ethanol is a supportive technology, like solar, wind, or hydroelectric. But it can't replace the fuels in our vehicles because there's no way to produce enough of it to completely offset oil. In fact, all the alternative energy technologies that are commercially feasible can't do it. It's called energy density, and so far we haven't been able to find a fuel that has both high energy density and a low conversion cost that can match dead dino fuel. Some of them have reached the point where they may be useful for daily commutes in an urban environment, but there is nothing yet created that I can put 80 pounds of it in my car and drive 400 miles, and then stop, wait for 5 minutes to refuel, and then continue. The few technologies that offer decent conversion efficiency and energy density usually have significant drawbacks. Natural gas, for example, has to be compressed to several hundred PSI in order to get a reasonable amount into a car. At those pressures, a hairline fracture in the tank will not only destroy the car, but anyone within a hundred feet of it... I'm not sure I like the idea of riding a bomb to work every day. That's just one example; there are many others, but they all suffer from the same physics problem: Energy density and conversion efficiency.

As a carrier trailing Verizon and AT&T in terms of subscribers and now 4G coverage, Sprint has made it a habit to undercut the other two on value. While its upcoming tablet-specific data plans won't necessarily be cheaper, they do promise up to 20 percent more data for the same price and still do not require a contract. Sure to come in handy now that it's offering the fourth generation iPad and iPad mini on its network, they are 300MB/$14.99, 3GB/$34.99, 6GB/$49.99, or 12GB for $79.99. There are also $10 and $15 offers for customers that also have Sprint smartphones that offer 100MB and 1GB of data, respectively, and activation fees for all 3G/4G tablets are being waived for a limited time. As you'll recall, Verizon and AT&T's offerings include 2GB/$30 (3GB/$30 on AT&T), 5GB/$50 and on Verizon, 10GB/$80 packages. Even if you're not an Apple user these plans apply for all 4G capable slates, with Samsung's Galaxy Tab 2 10.1 specifically mentioned. For those planning to pick up one of the latest iPads with wifi + cellular capability however, their mid-November launch date may have narrowed slightly , since these plans go into effect November 11th. The definitive list of the 12 most expensive colleges in the United States [SLIDESHOW]

While people have complained about the costs of undergraduate education for generations, things have really gotten out of control in the last decade or so. Loans, scholarships and grants allow most students to attend at some kind of discount. But the retail cost of a year of education is close to unconscionable at a slew of colleges and universities.

It?s hard to get a handle on the exact price tag for attendance at most colleges. When it comes to surreptitiously adding costs, college administrators are as subtle as the best three-card monte dealers and twice as creative. Matriculation fees, technology fees and the like are common.

The calculation of annual cost on this list assumes that students are living in a dorm and eating campus grub. Otherwise, the cost only includes unavoidable charges: tuition, various required fees, books, and supplies. (The estimate for schools that did not list the cost of books and supplies is around $1,000.) The prices in this list do not include any personal expenses, or travel expenses, or toothpaste or beer. All those things will drive the price even higher.

Sarah Lawrence College is the most expensive college in America. This is no surprise, as the school has also sat atop other lists such as this one in recent years. It?s quite possibly part of Sarah Lawrence?s crafty marketing strategy to maintain a ridiculously high price. Whatever the case, you should take the order of schools with something of a pinch of salt. Exact costs are sometimes hard to pin down, as mentioned above. Ultimately, the sticker prices at each of these schools are all impossibly expensive.

Biden Says Crying Baby Knows What Romney Win Would Bring

ST. AUGUSTINE, Fla.-What happens when a baby starts crying when Vice President Joe Biden is speaking at an event? Well the vice president finds a way to work that baby into his speech as he did in here Saturday afternoon, saying the crying baby knows how its future would pan out if Mitt Romney becomes president.

"They eliminate help for middle-class families who want to send their kids to college like that beautiful baby over there," Biden said as a baby cried at Ketterlinus Gymnasium Saturday. "I don't blame her for crying! I don't blame that baby for crying! That baby, that baby, that baby knows what's in store for him or her if Romney wins! I'm glad someone understands my speech!"

At the last stop of his two day tour through Florida, Biden highlighted the differences between President Obama and Romney, who he accused of deviating from the principles of the Republican Party and constructing a "morphed party."

"He's out of touch where I think this country is, where we move, and now, and now they're even abandoning the core organizing principle of this new Republican Party," he said. "This is not the Republican Party of ten years ago. This is not the Republican Party of 20 years ago. This is not even Mitt Romney's father's Republican Party. This is an alliance between the right in the Republican Party and the Tea Party-people I saw coming in here. I saw four or five of them."

As Biden's motorcade drove to Saturday's event, a few protesters dressed in colonial garb waved signs, including one that said "Bye-Bye Joe Biden Good Bye!"

The vice president touted the president's and his own performances in previous debates, even noting that his grandfather would be "happy" that "all of America knows what the word 'malarkey' means now," and ahead of the final presidential debate in Boca Raton, Fla., Monday, Biden stressed that President Obama has a strong character and will stand by his word.

"Folks, the stakes for this country are too high. They are too important. It's time for people standing for public office to stand up and say what they believe . Stand by what they say. Have the character of their convictions and state it," he said. "Presidential elections are about character and the character of your convictions and my guy he never tells you anything he doesn't mean and he doesn't do."

(AP) ? Offense has a lot to do with San Francisco's streak of 13 consecutive victories when Barry Zito is on the mound, given they're averaging more than six runs.

In Game 5 of the NL championship series Friday night, with their season on the line, they didn't need all that production. Not with the pitcher they thought they signed a half-dozen years ago showing up in shutdown form.

Zito dominated into the eighth inning of a 5-0 victory over the St. Louis Cardinals that sent the best-of-seven series back to San Francisco. The Giants cut their series deficit to 3-2 heading into Game 6 on Sunday night, with Ryan Vogelsong set to face Chris Carpenter for the second time in the series.

"We needed that kind of performance from him because there is no tomorrow for us," second baseman Marco Scutaro said. "We just needed to get back home."

The defending-champion Cardinals still have two chances to make it to back-to-back World Series as a wild card.

"It should be another battle," St. Louis third baseman David Freese said. "San Francisco is a great city, but I wish we weren't going back."

The 34-year-old Zito looked like the pitcher who won 23 games and the 2002 AL Cy Young with the Athletics. He retired 11 batters in a row at one stretch while scattering six hits with six strikeouts in 7 2-3 innings.

Giants catcher Buster Posey twice tapped Zito on the chest when he was pulled in the eighth. It was Zito's fifth postseason win but first since 2006, shortly before he left the A's and signed a $126 million, seven-year contract with San Francisco.

"This is definitely it for me," Zito said. "Coming here, really doing it in a Giants uniform. A lot of people were saying stuff about my A's days. And for me, the most important thing is doing everything for San Francisco right now."

Zito was left off the postseason roster when the Giants won the 2010 World Series because he had pitched so ineffectively.

"Well, you know, it was certainly a huge blow just personally to be left off that roster," Zito said. "But you've got to be professional, you can't pout and such like that.

"I worked on a lot of things that offseason, came back stronger for it, I think."

Zito's 15-8 record this year was his first winning mark since joining the Giants. He started Game 4 of the division series against the Reds earlier in this year's playoffs and lasted only 2 2-3 innings.

"He's been through a lot, I know," manager Bruce Bochy said. "But this guy, he is some kind of tough. He put on quite a show."

The Cardinals might have thrown away a chance to clinch a second straight World Series trip. Pitcher Lance Lynn's toss on a possible forceout deflected off the second base bag, paving the way for the Giants' four-run fourth.

Lynn was trying to turn the front end of a double play.

"I turned to throw it and I just threw it in the ground," Lynn said. "Just a bad play. You make a good throw there and we are out of the inning. It was one of those times where I just short-armed it a little bit."

Pablo Sandoval homered for the second straight night and Zito made an extremely rare offensive contribution with a perfectly executed bunt for an RBI single.

Giants defenders made several nice plays behind Zito, including a juggling catch in right by Hunter Pence and a spectacular sliding stop by Scutaro to rob pinch hitter Shane Robinson on consecutive at-bats.

"They were all huge," Zito said.

Once again this postseason, the Giants benefited from a big error.

Needing three straight wins at Cincinnati to avoid elimination in the division series, San Francisco began its comeback on a bobble by third baseman Scott Rolen in the 10th inning that gave the Giants the go-ahead run in Game 3.

The Giants improved to 4-2 on the road this postseason and have won Zito's last 13 starts, with the last setback on Aug. 2. They're averaging more than six runs during the streak, although the lefty didn't need much help in this one.

Lynn, an 18-game winner in his first year in the rotation, failed to make it out of the fourth for the second time in the series.

The Cardinals are seeking consecutive pennants for the first time since 1967-68, and trying to advance for the second year in a row as a wild-card entry. One more win would set up a rematch of the 2006 World Series against the Tigers, which the Cardinals took in five games.

Lynn struck out five of the first 10 batters, sailing through the first three innings with no balls hit out of the infield. His wild throw to second proved his undoing.

The Giants had runners on first and second with one out when Lynn gloved a tapper by Pence, wheeled and threw while Kozma hustled to second. Lynn's throw wound up in shallow right field and Scutaro scored without a play from second.

Eighth-place hitter Brandon Crawford singled up the middle with the bases loaded on a full count with two outs as Lynn just missed with a kick save for two more runs. Zito, who has just 30 hits in 310 at-bats in the regular season with no extra-base hits and nine RBIs, laid down a perfect bunt for a fourth run.

Lynn has allowed four runs in both of his NLCS starts, although all four were unearned in Game 5.

Longtime Cardinals broadcaster Mike Shannon bounced a ceremonial first pitch from in front of the mound to Lou Brock, teammates on the last St. Louis team to go to consecutive World Series in 1967 and '68. ... Cardinals rookie RHP Trevor Rosenthal struck out four in two scoreless innings. He has fanned 11 in 6 2-3 scoreless innings in the postseason while allowing just one hit. ... The Cardinals were shut out for the first time since Game 4 of the 2011 World Series, a 4-0 loss at Texas. ... Freese doubled in the second and has gotten at least one hit in all of his 14 postseason starts at home. It's the third-longest home hitting streak to start a postseason career.

Raptors Grab a Breather at San Francisco's Hawk Hill

In autumn, hawks and other birds of prey heading south for the winter funnel through Hawk Hill in the Marin Headlands north of San Francisco.

At 920 feet (280 meters) in elevation, the mountainous site, home of the Golden Gate Raptor Observatory (GGRO), is the perfect launching point for crossing the windy Golden Gate and San Francisco Bay. At one time, scientists believed the raptors resting at Hawk Hill were afraid of crossing open water, said Allen Fish, director of the GGRO. Now, Fish thinks the birds may be testing the area's tricky wind patterns and figuring out the easiest path.

"I've seen turkey vultures go directly over Golden Gate Bridge and ospreys fly out over the edge of the water," Fish told OurAmazingPlanet. "There are 19 different species, each with their own flying abilities," he said.

This year's numbers

This year's migration seems to be a better-than-average flight, Fish said. Since mid-August, volunteers have spent sunny days at the observatory spotting birds as they gather to glide on the rising thermals(bubbles of warm air). At the season's halfway point, they have counted 15,000 raptors and 18 of the 19 monitored species that pass through, Fish said. Due to the sheer number of raptors, people count hawks per hour, rather than try to identify and track individual birds. The peak day so far was Sept. 27, with 205 sightings in an hour and 822 for the day.

The numbers mean bird-watchers see group behaviors in the raptors, such as kettling ? birds circling the same thermal. "To me, it almost looks like they have an invisible bungee cord that keeps them 20 to 25 feet apart," Fish said of a hawk kettle he saw on Sept. 27.

Since tracking began in 1986, the populations of peregrine falcons, merlins and red-shouldered hawks have increased, the GGRO reports in published studies. None of the 19 monitored raptor species is clearly declining, although American kestrels have dipped in the past five years. [7 Iconic American Animals]

Rare species (for the West) often turn up during fall migration season, such as broad-winged hawks. Their normal range is the eastern United States and Canada.?The most common species are red-tailed hawks and turkey vultures.

Early visitors

One earlier-than-normal visitor in 2012 was the rough-legged hawk, who arrived from the tundra on Oct. 12 but usually appears around Nov. 1. "It's the earliest I've ever seen. I don't know if I buy into the story, but an early migration means that fall will be coming on pretty quick," Fish said.

Another Arctic traveler who regularly passes through Hawk Hill is the Swainson?s hawk.?Their amazing migration spans from northern Canada to Argentina, averaging about 14,000 miles (22,500 kilometers).

But not all raptors at the observatory are transients. GGRO scientists and volunteers also band and tag birds, also attaching radio transmitters to track their migration path. Through these efforts, they learned some raptors never leave San Francisco.

"If you look up and see a peregrine falcon, it might be heading for Tierra del Fuego along the southern Chilean coast or it might never leave Marin," Fish said.

Swept aside: Tigers dismiss Yankees in Game 4

Score and situation: ?No broom curses here. The Detroit Tigers did not delay the inevitable, putting away the punchless New York Yankees with an 8-1 victory in Game 4 of the ALCS on Thursday. The win sends the Tigers to their first World Series since 2006 ? which they also entered via sweep ? while mercifully sending the Yankees home for the winter. It's the first time the Yankees have been swept in the postseason since Kansas City beat them in the 1980 ALCS.

Leading lads: Miguel Cabrera and Jhonny Peralta each hit two-run homers off CC Sabathia in the bottom of the fourth inning to break the game open and make Detroit's coronation as American League champs an extended one. Peralta would later add a solo shot in the eighth inning to cap off the scoring in a series that saw the Tigers outscore the Yankees 19-6 over the four contests. Delmon Young went 2 for 4 with a RBI and was named ALCS MVP.

On the mound, Max Scherzer continued the unbelievable run of Detroit starters this October, losing a no-hitter on the first batter of the sixth inning and pitching 5 2/3 innings of one-run ball while striking out 10. In 61 2/3 innings of postseason work, Tigers starting pitchers have a 1.02 ERA and 66 strikeouts. They allowed only two runs to the Yankees all series. (Take away Jose Valverde's implosion in Game 1 and that's all they would have scored.)

(Getty Images)Head hangers: CC Sabathia may have saved the Yankees against the Orioles in the ALDS, but he wasn't worth the wait in this series. The big lefty lasted only 3 2/3 innings, giving up five earned runs, two homers and 11 hits. New York's entire lineup was also blameworthy with Robinson Cano posting an 0 for 4 to cap a 3 for 40 postseason that has seen him collect as many hits as St. Louis pitcher Chris Carpenter.

Key play: Peralta's two-run homer in the fourth inning came after Cabrera did the same and erased any doubt that Game 4 ticket holders would get a chance to party.

Interesting stat: According to whowins.com, this is only the fifth best-of-seven postseason series in which one of the teams never held a lead. The Yankees join the 2004 St. Louis Cardinals (WS Boston), 1989 San Francisco Giants (WS, Oakland), 1966 Los Angeles Dodgers (WS, Baltimore) and 1963 Yankees (WS, Los Angeles) to never enjoy an advantage.

What they'll be talking about: The national media is obviously going to focus on the fall of the Yankees and what offseason changes may or may not be coming. It'd be a shame, though, to not credit the Tigers rotation for how they've been pitching this month. It was their efforts that stopped Oakland, halted New York's well-paid sluggers and are sending the franchise to its 11th World Series appearance. There will be plenty of question about how the Tigers will handle closer Jose Valverde in the next matchup, but the reliability of the starters make his volatility a little easier to stomach.

What's next: The Detroit Tigers will head home to watch the NLCS and find out whether or not they'll be reporting to St. Louis or San Francisco for Game 1 of the World Series next Wednesday. The Yankees, meanwhile, will return back to the Big Apple for plenty of discussion (and suggestions) of how they can fix things going forward.

The arrival of Windows 8 is a good excuse for the PC industry to flood the market with so much hardware, consumers will be blinded by so much choice. Acer's jabbing its digits into your eyes with its new lineup of low-end desktops for the casual user. The ME micro towers will take an Intel Core i5 or I7, 2TB HDDs and up to 16GB of RAM. If you don't have anywhere else to stash your smartphone, the chassis comes with a recess desk on top with a USB port for easy charging. Those looking for something a little less demanding can pick up an XC desktop, a space-saving unit that will take an Intel Core i3, a 1TB HDD and up to 6GB of RAM. Prices for the ME begin at $700, while the cheaper XCs will set you back a much more modest $400.
